Acknowledgement & Agreement

The Borrower and Guarantor(s) — each of the undersigned — represent to Emvestments LLC (Emvest Finance) and to its actual or potential agents, brokers, processors, attorneys, insurers, servicers, successors and assigns, and agree and acknowledge that: (1) the loan requested pursuant to this application will be secured by a mortgage or deed of trust on the property described in this application; (2) all statements made in this application are made for the purpose of obtaining a commercial mortgage loan; (3) Emvest Finance and its agents may continuously rely on the information contained in the application; (4) I am obligated to amend and/or supplement the information provided if any material facts change prior to closing; (5) any intentional or negligent misrepresentation may result in civil liability. By submitting this application, each undersigned authorizes Emvest Finance to conduct a consumer credit report, background investigation, and order an appraisal to determine the property's value. All expenses incurred in pursuit of this loan, whether paid to Lender or a third party, are non-refundable.
